TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern your use of Owlchemy Play Lab LLC (“Owlchemy Play Lab,” “Owlchemy,” “we,” “us,” or “our”), including our website, facility, booking system, waiver system, open play sessions, private parties, events, programs, products, and services.
By accessing our website, creating an account, booking a visit, purchasing admission, signing a waiver, entering our facility, attending an event, purchasing a product, or otherwise using our services, you agree to these Terms.
If you do not agree, please do not use our website, services, or facility.
1. Description of Services
Owlchemy Play Lab is an indoor STEAM-based play space for children and families. Our services may include open play admission, visit passes, private parties, special events, waiver signing, website use, account registration, customer communications, purchases, custom items, 3D-printed items, merchandise, drinks, socks, and related services.
Our services, pricing, schedules, availability, hours, policies, and offerings may change at any time.
2. Eligibility, Adult Entry, and Supervision
Children must be supervised by a parent, legal guardian, caregiver, or responsible adult at all times unless Owlchemy expressly offers a specific drop-off program in writing.
Owlchemy staff may facilitate activities, maintain the environment, and enforce rules, but staff are not babysitters and do not provide constant individual supervision.
Adults may not enter the facility without an accompanying child unless approved by Owlchemy for a specific event, service, vendor purpose, tour, or other authorized reason.
3. Waiver Requirement
A completed waiver/release is required before entering play areas or participating in activities. A parent or legal guardian must complete the waiver for any minor child.
Owlchemy may require a waiver for every person entering or present at the facility, including children, parents, guardians, caregivers, party guests, vendors, instructors, spectators, and non-participating individuals.
Owlchemy may deny entry or participation to anyone without a completed waiver. Waivers may apply to present and future visits unless revoked or updated in writing.
4. Assumption of Risk
Participation in play, building, climbing, crafting, sensory, STEAM, and recreational activities involves inherent risks. These risks may include falls, collisions, cuts, scrapes, bumps, bruises, sprains, fractures, head injuries, allergic reactions, illness, communicable disease exposure, property damage, emotional injury, and other known or unknown risks.
By entering the facility, observing activities, supervising children, or participating in activities, you voluntarily assume the risks associated with use of the facility and activities.
5. Facility Rules
All guests must follow posted rules, staff instructions, safety policies, and facility procedures.
Rules may include, but are not limited to:
- Adults must actively supervise children.
- The facility is designed for children ages 3 and older.
- Grip socks are required for children in designated play areas.
- Shoes and bare feet are not permitted in play zones.
- Food, beverages, and strollers are not permitted in play areas.
- Climbing is permitted only on designated play structures.
- Running, rough play, throwing objects, and unsafe behavior are prohibited.
- Art materials, tools, cardboard cutting equipment, and craft supplies must be used only as instructed.
- Staff-only areas, storage rooms, restricted spaces, and back-of-house areas are off limits except where access is expressly permitted, such as restroom access.
- Guests who appear ill, have symptoms of contagious illness, or pose a health risk may be denied entry or required to leave without refund.
Owlchemy may remove any guest for unsafe behavior, rule violations, disruptive conduct, damage to property, failure to follow staff instructions, or other conduct Owlchemy determines inappropriate. No refund will be issued in such cases.
6. Socks, Shoes, and Strollers
Owlchemy is a shoe-free facility in designated areas. Grip socks are required for children in play areas. Adults must wear socks. Guests may bring their own socks or purchase socks onsite, subject to availability.
Strollers are not permitted in shoe-free or play areas and must be left in the designated stroller/cubby area or another area directed by staff.
7. Food and Drink
Food and drink policies may vary by service, booking type, or event.
For open play, food and drinks are not permitted in play areas. Drinks must remain with adults and in approved areas.
For private parties and approved events, outside food may be permitted subject to Owlchemy’s party policies and any signed party agreement. Owlchemy does not hold food-service permits. Food must arrive fully prepared. Owlchemy does not provide refrigeration, food preparation, heating, cooking, or food service unless expressly stated.
Unless expressly approved by Owlchemy, the following are not allowed: alcohol, smoking, vaping, cooking appliances, heating appliances, crock pots, air fryers, burners, chafing dishes, glass containers, open flames, chocolate fountains, or similar items.
8. Decorations and Balloons
Decorations may be limited by facility rules, mall rules, safety requirements, and party policies.
For private parties, small table decorations and approved balloon décor may be permitted. Air-filled, non-helium balloons must be weighted or attached. Loose balloons, helium balloons, ceiling decorations, confetti, glitter, poppers, streamers, silly string, piñatas, and messy decorations are not allowed unless Owlchemy expressly approves an exception in writing.
Decorations, food, gifts, party supplies, and personal items must be removed by the end of the scheduled booking unless Owlchemy agrees otherwise.
9. Open Play Admissions, Passes, and Purchases
Open play admission, passes, merchandise, socks, drinks, crafts, custom items, and other purchases are final and non-refundable unless Owlchemy states otherwise in writing.
Passes have no cash value, may not be resold, and may be subject to additional restrictions stated at purchase. Owlchemy may modify, discontinue, or limit passes and promotions at any time, subject to applicable law and any written terms provided at purchase.
Prices may change at any time.
10. Bookings, Cancellations, and Rescheduling
Booking policies may vary by service. Unless otherwise stated, bookings are non-refundable. Rescheduling may be allowed at Owlchemy’s discretion or as stated in the applicable booking policy, confirmation, or signed agreement.
Owlchemy may cancel, reschedule, modify, close, limit capacity, or suspend services due to safety concerns, illness, staffing issues, operational issues, mall closures, power outages, emergencies, government orders, acts of God, or other circumstances beyond reasonable control.
If Owlchemy cancels a booking, Owlchemy may provide a refund, credit, reschedule option, or other resolution at its discretion unless otherwise required by law.
11. Private Parties and Events
Private parties, birthday parties, facility rentals, and special events may be governed by a separate Private Party Rental, Arbitration, and Indemnification Agreement, booking confirmation, invoice, or event policy.
If there is a conflict between these Terms and a signed party agreement, the more specific signed party agreement will control for that party or event.
Private party terms may include non-refundable deposits, final balance requirements, cancellation fees, rescheduling fees, late-exit fees, cleaning fees, damage charges, outside food rules, decoration rules, setup/cleanup timing, waiver requirements, and guest conduct requirements.
12. Card on File, Payment Processing, and Additional Fees
Payments may be processed through third-party systems, including WellnessLiving and Paragon. Owlchemy does not store full credit card numbers on its own website servers.
By providing a payment method, booking a service, or authorizing a card on file, you authorize Owlchemy and/or its payment processors to charge amounts due for admissions, products, services, deposits, balances, fees, damage charges, cleaning charges, late-exit charges, cancellation fees, administrative fees, and other charges disclosed at booking, in a signed agreement, or in these Terms.
Declined, disputed, reversed, or unpaid payments may result in administrative fees, collection efforts, cancellation of bookings, refusal of future services, or other remedies permitted by law.
13. Custom, Personalized, and 3D-Printed Items
Custom, personalized, made-to-order, or 3D-printed items may be non-refundable once design, preparation, or production begins.
Colors, textures, finishes, size, material appearance, layer lines, and minor variations may occur. Custom items may contain small parts and may not be suitable for children under 3 unless expressly stated. Adult supervision is required.
Owlchemy may refuse custom orders that include inappropriate, unsafe, infringing, hateful, explicit, or otherwise unsuitable content.
14. Personal Property and Gifts
Owlchemy is not responsible for lost, stolen, misplaced, damaged, discarded, or forgotten personal property, including shoes, socks, clothing, bags, phones, strollers, gifts, gift cards, decorations, party supplies, food, drinks, or custom items.
For private parties, gifts and party items must be removed before departure. Owlchemy does not provide post-event storage unless expressly agreed in writing.
15. Photos, Video, and Social Media
Owlchemy may take general photos or videos of the facility, activities, displays, projects, or events for business, safety, training, promotional, or operational purposes, subject to applicable law and signed waiver/photo-release terms.
Our waiver may include consent for Owlchemy to record and use a participant’s likeness and/or voice, including for advertising, promotion, publicity, social media, and related business purposes.
If a parent or guardian has a specific concern about use of identifiable images of their child, they should notify Owlchemy in writing before or at check-in. Owlchemy will make reasonable efforts to honor such requests, but private guests may independently take photos or videos during visits or events, and Owlchemy cannot control all guest photography.
16. Website Use
You agree not to misuse our website, booking system, waiver system, forms, payment systems, social media pages, or online services.
You may not:
- Use the website or services unlawfully.
- Attempt to gain unauthorized access.
- Interfere with website operation.
- Submit false, misleading, or unauthorized information.
- Copy, scrape, reproduce, or misuse website content.
- Upload or transmit malicious code.
- Use our systems to harass, abuse, defame, or harm others.
We may restrict or terminate access at our discretion.
17. Intellectual Property
All website content, logos, graphics, photographs, designs, text, policies, forms, signage, branding, and other materials are owned by or licensed to Owlchemy Play Lab LLC unless otherwise stated.
You may not copy, reproduce, distribute, modify, sell, or use Owlchemy materials without written permission.
18. Privacy
Your use of our website, facility, booking system, waiver system, and services is also governed by our Privacy Policy.
19. Limitation of Liability
To the fullest extent permitted by law, Owlchemy Play Lab LLC shall not be liable for injuries, illnesses, accidents, property loss, property damage, theft, acts of other guests, misuse of equipment, violation of rules, service interruptions, closures, delays, or circumstances outside Owlchemy’s reasonable control.
Nothing in these Terms limits liability where prohibited by law.
20. Indemnification
You agree to defend, indemnify, and hold harmless Owlchemy Play Lab LLC, its owners, members, managers, employees, agents, affiliates, volunteers, contractors, and related parties from claims, damages, losses, liabilities, costs, and expenses arising from your conduct, your child’s conduct, your guests’ conduct, your violation of these Terms, your violation of facility rules, property damage, or misuse of the facility.
For private parties, the Party Organizer’s indemnification obligations may also be governed by the signed party agreement.
21. Arbitration Agreement and Waiver of Jury Trial
To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to your use of Owlchemy’s website, facility, services, activities, waiver, bookings, purchases, private parties, events, or these Terms shall be resolved exclusively by final and binding arbitration rather than in court, except where prohibited by law or where a valid written agreement provides otherwise.
This Arbitration Agreement is governed by the Federal Arbitration Act. Arbitration shall be administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect. The arbitration shall take place in Los Angeles County, California.
By agreeing to these Terms, you understand and agree that you are waiving the right to a trial before a judge or jury for any covered dispute.
All disputes must be brought solely in an individual capacity. No arbitration or proceeding may be conducted on a class, collective, consolidated, representative, or mass-action basis.
Owlchemy shall pay arbitration filing and administrative fees as required by AAA Consumer Rules, except for any initial filing fee equivalent to filing a civil action in California Superior Court, unless otherwise required by law. Each party shall bear its own attorneys’ fees unless otherwise required by law.
You may opt out of this Arbitration Agreement by providing written notice to Owlchemy within thirty (30) days of first agreeing to these Terms. The opt-out notice must be sent by certified mail and include your name, address, phone number, email address, and a statement that you are opting out of the arbitration agreement in Owlchemy’s Terms and Conditions.
22. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any court proceedings permitted under these Terms, including enforcement of arbitration awards or matters not subject to arbitration, shall be brought in Los Angeles County, California.
23. Electronic Signatures
You agree that electronic signatures, checkboxes, digital acknowledgments, online forms, and other electronic acceptances may have the same legal effect as handwritten signatures to the fullest extent permitted by law.
24. Changes to These Terms
We may update these Terms at any time. Updated Terms will be posted on our website with a revised “Last updated” date.
Continued use of our website, facility, booking system, waiver system, or services after changes are posted constitutes acceptance of the updated Terms.
